Default Blue Bay Village and the Lynx maintanace contract update

Well
Just got back from a fantastic trip to my apartmnet on Blue bay village ( weather 83 + most days )and can report the following

Evergreen
The Evergreen team have a guy on there sites most Mornings (Monday-Friday ) sorting out the snagging, his name is Richard, he got my remaining snagging issued sorted out very qiuckly and very proffesionally, thanks guys, this is a massive step in the right direction and shows a commitment to customer service!
Met a couple of smashing couples who now reside permantly at both Blue bay and Crystal Bay Veiw

Lynx

The main pool and kiddies Pool is now ready for use, and if you look at the Evergreen web site you will note my two boys making full use of these facilities on Tuesday

The other facilites such as the vending area, gymnasium and jacuzzi will be ready in the next few weeks
Met with Lynx Management to discuss the maintanance contract, I felt re-assured by there proffesionalism, however we all know the poof is in the pie, especially on 'service delivery' 'qaulity service' and value.

If you have already paid Evergreen for the water deposit you will not be reqiured to make it to Lynx

There is more clarity in this contract than in previous copies, it Just goes to say that people do take notice of our comments on the forum boards after all, dont you agree scott !

I have compared this contract with other similar management company agreements, although not entirely 'like for like' they are all pretty much the same and offer the same T&C's.

Last but not least
The added electricity costs !
Had a meeting with Evergreen director regading this and on the back of our in depth discussion and some follow up investigations by myself with other purchasers from other developers this requests is across the board and not confined to Evergreen
With that said I did point out again that reputations where challenged simply by the lack of any sensible informative correspondance /communication regading this payment and a lack of a reasonable time scale to pay the extra costs
Things could be a lot worse ladies and gents, I guess.

Just one point to note
Sadly it was felt by some purchasers ( not Blue Bay )that I was deemed to be puting there investments at risk of devaluation by making negative comments, there was also some suggestion of possible litigation, Im sure I dont need to remind people that forum boards are based on ones abilty to voice an opinion ! like it or not, therfore to those investors who feel wronged by my commnets please feel free to PM me and I will happily call you and let you know my opinion vocally with the sound switched on !!!!!

Default Need for Residents Assoication: Crystal Bay View & Blue Bay Maintenance contract

I am sorry to inject a despondent note BUT

1. yes Richard is very professsional - but he can only ask, he can't make things happen.

3 weeks ago i was told that my - major - unfinished items would be completed "in a few days".

I have just made a second trip - 3 weeks later- and ABSOLUTELY NOTHING has been done! Moreover, Evergreen cannot say when it will be done. They are doing their best, I feel sure, but the sub-contractor is not cooperating.

2. I personally have strong positive feelings about Evergreen. I like them. But they make promises that don't get kept. I don't feel that it's their fault - I think that they are trying to meet their obligations.

There is no sign of any beginning of work on the Gymnasium/Jacuzzi - and it simply isn't realistic to expect the facility to be built "next week" as i have been told it will be. If it's completed by end July, I shall be very pleasantly surprised!

3. Electricity. it's fiat of government and we are contractually obligated. We are obliged to pay our proportionate quanta of costs and complaining will do us no good. BUT - what are those costs? Why haven't we been given a breakdown? I've asked for one...

4. ditto Water. I did the arithmetic, posted it on this forum, pointed out that payment demands were being duplicated, and asked for a costs breakdown: mailed to Evergreen, Lynx, our solicitor, and Richard.

No response from anyone - but now Panhandler says that Lynx have acknowledged - to him -that the "double demand" was an error.

I'm sorry, that's not professional behaviour. In fact it's most unprofessional! You overcharge your customers by more than £50,000, you tell no-one that's happened unless they are on the spot confronting you, you ignore requests for info, you refuse a costs breakdown!!! Nice one.

4. Maintenance Contract: Is this really the kind of firm we want "looking after our interests" (hah!) when we are thousands of miles away and helpless?? How often are we going to be overcharged in smaller amounts that we don't query? How will we know that's even happened when we don't get a costs breakdown?

Besides, the charge for Lynx's services is over £60,000 per annum payable in advance!! AND they want a "float" of £40,000+?? What are they going to be spending all that money on?

Why should we put well over £100,000 in their pockets, to do an amount of work that we could sort out ourselves with one part-time secretary [costing £5000 at most] who would co-ordinate the subcontractors for pool and grounds and pay communal utility bills (which is ALL that Lynx will be doing)?

Let's get real, people! We're being ripped off here ferociously, and for THIS outrage we are NOT legally obliged to hold still...

5. Residents Association: we badly need to organise ourselves into a Group who will collectively protect each individual owner. Elect a Committee, get the Committeee to organise a sensible maintenance contract and find people to do the necessary work at reasonable cost.

Let's do that now, before it's too late!

1.Firslty Richard did make things happen final snagging was completed whilst I was in residence, however I can only speak for myself and a few others at this piont

2. Evergreen have a very good product, otherwise we would not have purchased, that said, they have have a lot to learn regarding Customer Service,and communication but I feel they are moving in the right direction

3. I agree a breakdown should have been provided, although the figure is similar to other developments, you are right to note this.

4. Miantanance contract, overall not bad, again I have drawn comparisons with other contracts with other companies,
Ours will I believe be offering us a forum board /web site whereby we can veiw accounting details costs / visible expenditure in relation to our respective developments
I believe that a forum board for the residents of each developemnt will also be available for communication between the residents and the management company

5.Let me cast the firt vote for the residence committee, i think Anastasia would make a very good chairperson

Anastasia hits most nails directly on the head. I agree with Pan that Lynx are good but remember they are being subcontracted by Evergreen who are actually the management company.

WE are not under an obligation to contract with the proposed company but if they're good then we should have no problem. They have a made some significant improvements since they started working on the site.

The devil's in the detail (and I have read my contract carefully and don;t like what I'm giving up versus what I'm getting). Getting a residents committee going is important anybody else agree??
