Default Blue Bay Village and the Lynx maintanace contract update

Well
Just got back from a fantastic trip to my apartmnet on Blue bay village ( weather 83 + most days )and can report the following

Evergreen
The Evergreen team have a guy on there sites most Mornings (Monday-Friday ) sorting out the snagging, his name is Richard, he got my remaining snagging issued sorted out very qiuckly and very proffesionally, thanks guys, this is a massive step in the right direction and shows a commitment to customer service!
Met a couple of smashing couples who now reside permantly at both Blue bay and Crystal Bay Veiw

Lynx

The main pool and kiddies Pool is now ready for use, and if you look at the Evergreen web site you will note my two boys making full use of these facilities on Tuesday

The other facilites such as the vending area, gymnasium and jacuzzi will be ready in the next few weeks
Met with Lynx Management to discuss the maintanance contract, I felt re-assured by there proffesionalism, however we all know the poof is in the pie, especially on 'service delivery' 'qaulity service' and value.

If you have already paid Evergreen for the water deposit you will not be reqiured to make it to Lynx

There is more clarity in this contract than in previous copies, it Just goes to say that people do take notice of our comments on the forum boards after all, dont you agree scott !

I have compared this contract with other similar management company agreements, although not entirely 'like for like' they are all pretty much the same and offer the same T&C's.

Last but not least
The added electricity costs !
Had a meeting with Evergreen director regading this and on the back of our in depth discussion and some follow up investigations by myself with other purchasers from other developers this requests is across the board and not confined to Evergreen
With that said I did point out again that reputations where challenged simply by the lack of any sensible informative correspondance /communication regading this payment and a lack of a reasonable time scale to pay the extra costs
Things could be a lot worse ladies and gents, I guess.

Just one point to note
Sadly it was felt by some purchasers ( not Blue Bay )that I was deemed to be puting there investments at risk of devaluation by making negative comments, there was also some suggestion of possible litigation, Im sure I dont need to remind people that forum boards are based on ones abilty to voice an opinion ! like it or not, therfore to those investors who feel wronged by my comments please feel free to PM me and I will happily call you and let you know my opinion vocally with the sound switched on !!!!!

From my conversations I can confirm what you say about the across the board electricity charge and we are probably contractually obliged to pay. I also already paid my water and didn;t have to pay again so again Pan is correct.

On the contract, the management company is Trever Green North Cyprus (which is another Evergreen company) they will have subcontracted to Lynx and as you can see from my earlier thread I was also impressed by the people I met there, Jackie and Anthony. Evergreen will however have the ability to terminate their contract with Lynx independantly of whether we terminate ours with Trever Green. The notice period under which we can terminate the contract is i) too long (12 months plus the current year - should we match Trever Green's contract with Lynx) and ii)should have a carve out for any increase in monthly fee beyond say 5% (ie if they increase the costs unreasonably and we all find an alternative we're happier with) we shouldn't be obliged to pay that fee. Under the terms of the agreement Trever Green will have the ability to dictate colour schemes etc. Whilst this is very unlikely to cause a problem to anybody we should have the ability for the residents to approve any change to the original coulour scheme (either by majority approval or by agreement with representatives of the residents). The thought of arriving at my apartment to find it had been painted purple whilst I agree unlikely could technically be covered by 3j. Contracts are afterall all about what we do when it all goes pear shaped.

Am I barking amd of does anybody else agree??

We have been in contact with Richard frequently over the last few weeks, and he had kept us updated on progress at CBV and we have arranged an ‘after snagging’ appointment with him at our apartment next week when we have taken possession.

The contract presented by Lynx is certainly better than the previous attempt, and have come to the conclusion that it is about the best we are going to get. While we are in Girne next week we intend to call in the office to discuss matters further, and get more details of the other services they provide.

We have read posts on 44 regarding additional charges for electric supply from buyers on different developments, and realise that we are not alone in this department. It’s just the way Evergreen presented the bill without prior notification to a select few at CBV with a minimal deadline payment period. We have arranged to discuss the matter further next week.

Don’t think you are barking, and agree with all of your comments, and are looking forward to meeting Lynx next week. They appear to be a professional outfit and the monthly customer reports will give us an idea whether they are spending our money wisely.

With my business head on I would done exactly the same thing that Trevor green have done to retain an interest in their Developments /assets, so from that perspective I agree with (Tr) evergreen, it makes commmercial sense to do so

Rather than look at this negatively I woild suggest that its a good thing as potentially Lynx will work hard to ensure they retain these contracts but also to possible secure future business from Trevor Green ?
Surely this is a good thing for the residents of Blue Bay and Crystal Bay view

This is only my assumption, and it kind of makes sense from where Im standing.

Agreed, and with my business head on a management services agreement has got to be a good thing and should be looked at positively.

Most of what is in the agreement is absolutely fine and there are only two real concerns for me 1) the length of time we could be committed to Tr (Evergreen) after the service level they deliver falls below that that is acceptable or they increase their price to an unacceptable level. 2) there should be some formal recognition in the contract of the wishes and will of the owners. At the moment this is purely down to the management company.

Other than those two things I'm a big supporter.

We also support the proposed contract, but will raise the further questions with them when we meet this/next week.


I'm leaving on a jet plane
don't know when I'll be back again.

Weather is fantasic, enjoy the pool the drinks and whart ever else you are up to !.Only wished I could be there with you guys .

Did you get round to actually buying a jetski ? I did say you could borrow my inflatable....

I was there a couple of weeks ago to get my keys (and queue up at the electricity office - great fun). Had no fridge and hence no drinkies weather was great site was coming along and as stated impressed with Lynx so far.

Have a good trip let me know how you get on with the contract 'negotiations'
